Land Rover LR2 Battery Replacement Lawsuit Survives

A Land Rover LR2 battery replacement lawsuit will continue in court, but only after a U.S. district judge dismissed much of the lawsuit filed against Land Rover. The 2008-2015 Land Rover LR2 battery replacement lawsuit was filed in 2015 by lead plaintiff Amy Block who alleges the battery drains easily and quickly, causing an expensive replacement of the battery.

The LR2 class-action lawsuit says electrical problems cause constant replacement of the batteries and even when the automaker pays for the replacement, the new battery succumbs to the alleged electrical defects.

Specifically, the lawsuit alleges a problem with a control module can drain the battery when the LR2 engine is shut down, eventually causing the battery to be too weak to start the LR2.

Owners of the LR2 say the battery can die suddenly and unexpectedly.

"After driving vehicle normally without any sign of a problem for about an hour then parking for about 20 min the battery was dead, unable to start by jumping from several larger vehicles. Following being towed to the dealer to have the battery replaced, no explanation for battery failure." - 2008 Land Rover LR2 owner / New Orleans, Louisiana

The judge dismissed claims for violations of fraud laws, breach of good faith and unjust enrichment, but the judge let stand certain claims against Land Rover for breach of express and implied warranties.

The judge dismissed most of the claims because the plaintiffs didn't list details about misrepresentation concerning manufacturing defects. Additionally, the plaintiffs didn't prove Jaguar Land Rover intentionally harmed expectations held by buyers of the LR2.

A separate claim of unjust enrichment fell after the judge said the evidence didn't show a direct relationship between the plaintiff and Jaguar Land Rover.

The plaintiffs can again file the dismissed claims but only if they aren't related to the alleged defects involved in the battery replacement lawsuit.

The Land Rover LR2 battery replacement lawsuit was filed in the U.S. District Court for the District of New Jersey - Block v. Jaguar Land Rover North America, LLC.
